Key Amendments to Employment Act 1955 Effective 1 Sep 2022

  • From 1 September 2022, all employees in Malaysia will be entitled to benefits and protection under the Employment Act [EA] (such as annual leave, sick leave, lawful deductions, wage period, time of payment of wages and etc.)
  • However, the sections of the EA in relation to overtime payments and termination benefits will not apply to employees whose wages exceed RM4,000/month
  • Employers are advised to review and revise their terms and conditions of employment to ensure compliance with the Act. Failure to comply with the provisions of the Act will on conviction, attract a financial penalty up to a maximum of RM100,000, and a director, manager or officer of a body corporate may be charged jointly or severally for the offences.
